Privacy policy for Domotel Sp. z o.o. hotel facilities.

§1. GENERAL PROVISIONS

1.This Privacy Policy applies to persons using the Website located at the URL:

2. The administrator of users' personal data is: [P1]Domotel Sp. z o.o. with its registered office in Gdańsk 80-755, Szafarnia 10 Street, entered in the Register of Entrepreneurs of the National Court Register under the KRS number 0000384263, with the share capital of PLN 5,000.00 fully paid up (hereinafter referred to as "We", ADO).

§2. PERSONAL DATA

Following the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation – hereinafter referred to as “GDPR”), we inform you that:

  1. We process data for the following purposes:
    1. performance of the contract or taking action at the request of the data subject before concluding the contract (legal basis: Article 6(1)(b) of GDPR),
    2. handling inquiries (Article 6(1)(f) of GDPR),
    3. handling complaints and claims (Article 6(1)(b) of GDPR),
    4. keeping records and fulfilling legal obligations imposed on the Controller (Article 6(1)(c) of GDPR),
    5. sending a newsletter (Article 6(1)(a) of GDPR),
    6. monitoring and improving the quality of the services – requesting completion of a survey or answering some questions about the quality of the services provided (Article 6(1)(f) of GDPR),
    7. displaying personalized commercial information on social networks (Art. 6(1)(a) of GDPR)
  2. Providing data is voluntary, yet essential to use the services. In the case of expressing consent, it is voluntary and expressed by clicking the checkbox that includes the conditions of the consent granted.
  3. If a person has agreed to the processing of data (legal basis: Article 6(1)(a) of GDPR), the data is processed until the consent is withdrawn, but after this period, we have the right to archive information on who and when, and what consent was given (to establish, assert or defending legal claims). In other cases, the data is processed for the period justified by the execution of the purpose (e.g. performance of the contract, answering questions, tax regulations, etc.). The period of processing depends on the possibility of establishing, asserting, or defending claims or when data retention is required due to tax regulations.

  5. Each data subject has the right to access, correct, delete or restrict the processing of personal data, the right to object, the right to transfer data, and the right to complain with a supervisory authority.
  6. Transaction data, including personal data, are transferred directly by the user to the payment service provider.
  7. The Website visitors may fill in a form and subscribe to the newsletter and provide an e-mail address and/or telephone number for the automated contact.
  8. The Website visitors may express their consent for Us to run advertising campaigns on social networks targeted based on their email addresses.

§3. DATA RECIPIENTS

We use the services of software and ICT system maintenance companies with whom We have entered into appropriate agreements. These agreements include data processing rules and confidentiality. The data is not shared and none of these companies has the right to process the data in any other way than specified in the contract. Your data, if the company has access to it, may be processed only for the proper provision of services.

§4.DATA RETENTION PERIOD

1.Personal data processed on the basis of a separate consent (Art.6(1)(a) RODO) will be processed until revoked;
2. personal data processed in connection with the conclusion or performance of the contract will be processed for the duration of the contract ( for the provision of hospitality services) concluded with you, as well as after its termination, until the end of the period of limitation for potential claims under the contract in accordance with the applicable legal provisions on limitation periods;
3.Personal data processed in connection with the performance of legal obligations, e.g. tax and accounting, provision of electronic services, will be processed for the period indicated in the laws imposing certain obligations on the Administrator or until they are fulfilled.
4.The processing of your personal data based on the legitimate interests of the Administrator (e.g. direct marketing, profiling, analytical purposes) will be carried out until you object to the processing for these purposes, unless the Administrator demonstrates the existence of valid legitimate grounds for processing that override your interests, rights and freedoms or grounds for establishing, asserting or defending claims. The processing of your personal data for marketing purposes will be carried out for the duration of the contract or until you object to such processing.
5. The processing of your personal data obtained by means of monitoring will, in principle, be kept for a period of 30 days. In justified cases, when justified by the Administrator's legal interest or by law, personal data will be kept for the time necessary to fulfill the Administrator's legal obligations or satisfy its legitimate interest.

§5.YOUR RIGHTS

You have the right to: request from the Administrator access to your personal data, rectification, deletion, restriction of processing, as well as the right to object to processing and the right to data portability; withdraw consent to the processing of personal data at any time without affecting the legality of the processing performed on the basis of consent before its withdrawal; lodge a complaint to the supervisory authority, which is the President of the Office for Personal Data Protection. Your provision of personal data is voluntary; however, the provision of certain data is necessary for the conclusion and performance of the contract. Failure to provide certain data may result in the refusal to conclude a contract or the inability to properly perform it.

§6.RIGHT TO OBJECT

1. You have the right to object at any time - on grounds relating to your particular situation - to the processing of personal data concerning you based on a legitimate interest pursued by the Controller or by a third party, including profiling carried out on the basis of this provision. In that case, we will no longer be allowed to process such personal data unless we demonstrate the existence of compelling legitimate grounds for the processing overriding the interests, rights and freedoms of the data subject, or grounds for establishing, asserting or defending claims.
2. In addition, if your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing, including profiling, to the extent that the processing is related to such direct marketing.

§7.COOKIE POLICY

We collect " Other Data " that generally does not involve the disclosure of your identity or does not directly relate to an identified person. To the extent that Other Data reveals your specific identity or relates to a person, we will treat Other Data as Personal Data. Other Data includes:

User's browser or device. We collect certain data through your browser or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Apple), screen resolution, operating system name and version, device manufacturer and model, language, browser type and version, and the name and version of the Online Services (such as Apps) you use. We use this data to ensure that the Online Services work properly.

Use of the Application. We collect certain data when you download and use the Application, including data about your use of the Application, the date and time the Application accessed our servers on your device, and information about the data and files you downloaded to the Application based on your device number. We use this data to ensure the proper operation of the Online Services. Our Applications may include software development kits (SDKs) from third parties that may collect and transmit Other Data to enable various features on the Application. We may also collect mobile device advertising identifiers to improve and personalize your experience and to provide you with relevant products, content or advertisements to be displayed on our website, apps or third-party advertisements.

Optional Application Features. Our Apps may include optional features provided to developers by your device's operating system. To improve your experience, we may ask for your permission to use your device's location, camera, or other features (e.g., using your device's camera to capture your credit card information).You may choose not to allow such features, in which case the Application features requiring them may not be available to you. To manage these permissions, go to your device settings.

Cookies. We collect certain data from cookies, which are pieces of data stored directly on the computer or mobile device you use. Cookies allow us to collect information about browser type, time spent on the Online Services, pages visited, referring URL, language preferences and other aggregated traffic data. We use functional cookies to obtain data to ensure security, facilitate navigation, display content more efficiently, collect statistics, personalize your use of the Online Services, and recognize your computer to assist you in using the Online Services. We also collect statistical data from cookies about your use of the Online Services to continuously improve the design and functionality, to learn how they are used, and to help us resolve any issues. Third Party Advertising:

We may use third-party advertising companies to display advertisements about goods and services that may be of interest to you when you use the Online Services, other websites or online services. To serve such advertisements, these companies place or recognize a unique cookie on your web browser (including through pixel tags). Pixel tags and other similar technologies. We collect data from pixel tags (also known as Web beacons and clear GIF files) that are used with certain Online Services to, among other things, track the activities of Online Services users (including email recipients), measure the success of our marketing campaigns, and compile statistics about the use of Online Services.

Analytics. We collect data through Google Analytics and Adobe Analytics, which use cookies and technologies to collect and analyze data about your use of the Services. These Services collect data about your use of other websites, applications and online resources. User IP Address. We obtain your IP address, which is a number automatically assigned to the computer you use by your Internet Service Provider (ISP).Your IP address is identified and automatically recorded in our server log files when you access the Online Services, along with the time of your visit and the pages visited. We use IP addresses to calculate usage levels, diagnose server problems and administer the Online Services. The approximate location of the user can also be obtained from the user's IP address.

Aggregated and segmented data. We may aggregate the data we collect, and this aggregated data will not personally identify any user. We may also use both personal and other data to segment or group customers to provide better-tailored advertising.

Precise location services. With your consent, we may determine the exact physical location of your device using satellite, cell phone tower, Wi-Fi signals or other technologies. We will collect this data if you give us permission through the App or another program (when you first log in or later) to improve special offers and enable location-based features on your device. If you have agreed to share your location, the App or other program will continue to collect location data based on how you have chosen to share that data.

Opting out of exact location: the user can specify through the device's operating system to always share location, only when the App is used or never.
